Marijuana Key Points
Taxation
Currently, municipal governments will receive a general sales tax on marijuana similar to other goods bought and sold in your municipal boundaries.
Zoning & Land Use
SB1030 allows municipal governments to follow their standard planning and zoning processes.
NOTE: Municipal governments may not ban retail establishments from municipal limits.
Employment
SQ 788 prohibits employers from discriminating against an employee for holding a marijuana license. However, action may be taken against these employees if:
The holder of the license uses marijuana in his or her place of employment or during hours of employment.
Unless a failure to do so would cause an employer the potential to lose a monetary or licensing-related benefit under federal law or regulations.
Action may not be taken against a marijuana license holder due to results of a drug test showing positive for marijuana or its components. HOWEVER, there are possible actions if the employee is employed in a position classified as safety sensitive under state law. Work with your municipal attorney on this aspect of law.
